NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR TO WIN. NO PURCHASE OR PAYMENT OF ANY KIND WILL INCREASE YOUR CHANCES OF WINNING.

By entering this Contest, I accept and agree to the terms and conditions and set forth in these Official Rules. I confirm I am a U.S. resident and at least 21 years of age as of the date that I enter this Contest. By entering this Contest, I agree that I am opting-in to receive promotional news and special offers from Rock Steady Sodas, Gene Simmons Moneybag Sodas, Hammock Cove Antigua, and Elite Island Resorts (collectively, the “Associated Companies”). While the Associated Companies have provided prizes for this Contest, Hammock Cove Antigua is sponsoring and operating this Contest. No Purchase Necessary. A purchase of any kind will not increase your chances of winning. This Contest is subject to federal, state, municipal, and local laws and regulations and is void where prohibited.

Eligibility: Vacation Like A Rock Star at Hammock Cove Antigua! (the “Contest”) is open to anyone who is at least twenty-one (21) years of age, a U.S. resident, and has a valid email address and/or Instagram account. Employees, independent contractors, interns, officers, directors, and agents of Hammock Cove Antigua and the Associated Companies are not eligible to enter. All travelers must have a valid U.S. passport that is valid for at least six (6) months after your desired travel dates.

Sponsor: This Contest is sponsored by Hammock Cove Antigua, Devil’s Bridge Road, St. Phillips North, Antigua, West Indies.

Agreement to Official Rules: By entering this Contest, you indicate your full and unconditional agreement to, and acceptance of, (a) these Official Rules and (b) Sponsor’s decisions, which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein.

Entry Period: The Contest begins at 12:00 noon EST on September 6, 2022 and ends at 4:00 pm EST on October 28, 2022 (the “Entry Period”). Entries submitted before or after the Entry Period will not be eligible. Sponsor’s computer is the official timekeeping device for the Contest.

Two Ways to Enter: 

Enter with Email: From the beginning of the Entry Period, you may enter the Contest by visiting the Contest site https://www.hammockcoveantigua.com/mbcontest (the “Contest Site”) and completing the Contest entry form. There is a limit of one (1) entry per person/email address. Additional entries per person/email address will not be acknowledged.

OR

Enter with Instagram: From the beginning the Entry Period, you may enter the Contest by following @MoneybagSodas on Instagram then simply post your best original Moneybag Sodas photo on Instagram, tag your photo with @MoneybagSodas and use hashtag #moneybagcontest.

The use of an agency or any automated system to enter is strictly prohibited and Sponsor reserves the right to disqualify any entries received through such methods, as determined by Sponsor, in its sole discretion. By entering this Contest in accordance with the entry process described above, you will be opting in to receive email communications from Rock Stead Sodas, Gene Simmons Moneybag Sodas, Hammock Cove Antigua, and Elite Island Resorts. Any information you provide may be used by these Associated Companies for further promotional purposes.

Drawing: After the Entry Period, on or about October 31, 2022, Sponsor will select one (1) potential winner in a random drawing of all entries received. The odds of being selected depend on the number of entries received.

Notification and Requirements of Potential Winners: Sponsor will attempt to notify potential winner within five (5) business days of the drawing by email or by Instagram messenger, based on how the potential winner entered this Contest. If the potential winner does not respond within five (5) calendar days after the notice is sent, the Sponsor will select an alternate potential winner in his/her place at random from all remaining entries received. Up to three (3) alternate potential winners will be notified, as may be needed to select a winner. Except where prohibited, the potential winner may be required to complete and return an affidavit of eligibility and liability/publicity release. If a potential winner fails to sign and return these documents within the required time period, an alternate potential winner may be selected in his/her place in a random drawing of all remaining entries received.

Prize(s): One (1) grand prize will be awarded and one (1) winner will be chosen.

Description of Prizes: Grand Prize (total value of approximately $13,000):

Five (5) Nights for two (2) adults at the 5-star, All-Inclusive Hammock Cove Antigua. Deluxe villa accommodations at Hammock Cove Antigua; gourmet dining (breakfast, lunch, dinner); unlimited drinks by the glass (alcoholic and non-alcoholic); resort activities such as swimming, snorkeling, kayaking, paddle boarding, Hobie Cat sailing, Pickleball, fitness center and more; one 45-minute couple’s massage treatment at the resort’s spa; $500 airline credit; ground transportation to and from the VC Bird International Airport in Antigua; and a limited edition Moneybag Sodas Guitar hand-signed by Gene Simmons.

Travel prize is valid for travel between November 1, 2022 and December 22, 2023 with blackout dates of December 23, 2022 – January 2, 2023 and the entire month of February 2023. Resort stay dates are subject to availability at time of booking. All prizes are non-transferable, may not be redeemed for cash, and may not be offered for resale.

General Conditions: If the operation, security, or administration of the Contest is impaired in any way for any reason, including, but not limited to virus, fraud, or any technical issue or problem, Sponsor may, in its sole discretion, either: (a) suspend the Contest to address the impairment and then resume the Contest in a manner consistent with the spirit of these Official Rules; or (b) award the prize(s) at random from among the eligible entries received up to the time of the impairment. Sponsor reserves the right in its sole discretion to disqualify any individual that Sponsor finds to be tampering with the entry process or the operation of this Contest or to be acting in violation of these Official Rules or in a disruptive or unfair manner. Any attempt by any person to undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Failure by Sponsor to enforce any term of these Official Rules shall not constitute a waiver of that specific provision. Proof of sending any communication to Sponsor by mail shall not be deemed proof of receipt of that communication. In the event of a dispute as to any online entry, the authorized account holder of the email address used to enter will be deemed to be the Contest entrant. The “authorized account holder” is the natural person who is assigned the relevant email address by an Internet access provider, online service provider, or similar organization responsible for assigning email addresses for the domain associated with the email address submitted for Contest entry purposes.

Release and Limitations of Liability: By participating in the Contest, you agree to release and hold harmless Sponsor, its parent, subsidiaries, affiliates, the prize providers and each of their respective officers, directors, employees, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Contest or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Contest; (b) technical errors related to computers, servers, providers, or telephone, or network lines; (c) printing errors; (d) lost, late, postage due, misdirected, or undeliverable mail; (e) errors in the administration of the Contest or the processing of entries; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt or use of any prize. You further agree that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Contest, and in no event shall the Released Parties be liable for any attorneys’ fees, court costs, or any other legal expenses of any kind whatsoever. You waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages in connection with this Contest or any prize.

Privacy and Use of Information Submitted; Publicity: Any information you submit as part of the Contest will be used for purposes of this Contest and treated in accordance with Sponsor’s privacy policies as otherwise set forth in these Official Rules. Except where prohibited, participation in the Contest constitutes an entrant’s consent to Sponsor’s and Associated Companies’ use of his/her name, likeness, voice, opinions, biographical information, and state of residence for promotional purposes in any media without further payment or consideration.

Use of Entrant Information: By entering the Contest, you acknowledge and agree that Sponsor and the participating Associated Companies will use your information including without limitation your email address, phone number, mailing address, or any other contact information provided for general solicitation, marketing, or other business or promotional activities in connection with the services and products provided by Sponsor or the participating companies. You may at any time opt-out by responding to a marketing email using the unsubscribe link provided in the email. Please note that your opt-out preference will apply to marketing communication and may not apply to transactional communication including those associated with your entry in this Contest.

Disputes: Except where prohibited, you agree that any and all disputes, claims and causes of action arising out of, or connected with, the Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Antigua, West Indies, and all other venues that the Contest entrant, Sponsor, and Associated Companies may have access to by reason of domicile or otherwise are hereby waived. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of Antigua and Barbuda, without giving effect to any choice of law or conflict of law rules that would cause the application of the laws of any jurisdiction other than Antigua and Barbuda.

Third Party Platforms: If this Contest is hosted, administered, or operated on a third party platform, including without limitation a social media platform (e.g. Instagram, Facebook or Twitter) (“Third Party Platform”), then by participating in this Contest, entrants hereby release and agree to comply with all rules and policies set forth by such Third Party Platform and to hold harmless such Third Party Platform from any and all liability, loss or damages arising from or in connection with the awarding, receipt, and/or use or misuse of prizes or participation in any prize related activities. Unless otherwise stated to the contrary in these Official Rules, this Contest is not sponsored, endorsed or administered by, or associated with, any Third Party Platform.

Results: To request a winners list, send a self-addressed, stamped envelope to Hammock Cove Antigua, c/o Elite Island Resorts, 1065 SW 30^th Avenue, Deerfield Beach, Florida 33442, Attention: Legal Department. Requests must be received within four (4) weeks of the end of the Entry Period.
